Terms of service

These terms are the agreement between you and [Company], of [Company address] (“Yester”, “we”, “us”), for the Yester app and service. By creating an account or installing the app you agree to them. They are written to be read; where they are silent, the law of [Jurisdiction] applies.

1. What Yester is

Yester backs up Macs (and, as add-ons, external drives) to cloud storage every hour, keeps a history of versions, and restores files, folders or whole Macs. Yester is provided as a subscription service. It is not a substitute for keeping your own copies of things you cannot afford to lose.

2. Your account and devices

You need an account, signed in with Apple or by email code. One account holds all of your devices. Each Mac and each external drive is its own subscription (“device line”), priced by the Mac’s built-in storage and plan, or by the drive’s whole terabytes. Storage is per device and is never shared or pooled between devices.

You are responsible for the devices on your account, for keeping your sign-in secure, and for making sure you have the right to back up the data on them.

3. Encryption and your recovery key

Everything you back up is encrypted on your Mac with a key that only your recovery key can unlock. We never hold your recovery key or your data key. We cannot recover your data if you lose your recovery key, and we cannot read your backup under any circumstances. Keeping the recovery key safe is your responsibility; the app offers to store a copy in your iCloud Keychain.

4. What is kept, and for how long

  • Kept while paid. The current state of everything on a paid device line is kept for as long as that line is paid for, whether or not the device is connected.
  • History window. Older versions and deleted files are kept for the plan’s window: 90 days on Yester, 1 year on Yester Pro, 5 years on Yester Max. External drives follow the longest Mac plan on the account, and at least 90 days. History is thinned as it ages: hourly for 24 hours, daily for 30 days, weekly to the end of the window.
  • Fair use on Yester Max. Yester Max keeps up to five times your Mac’s built-in storage in version history. If a Mac approaches that limit we will tell you before anything changes, and history beyond it may be thinned more aggressively.
  • Deletion. Nothing on your Mac can delete a backup. Versions are removed only by our retention rules when they pass the window, and a 30-day safety net applies behind that.

5. Prices and payment

Prices are shown per device line on the pricing page, in GBP, EUR or USD, and are charged monthly or yearly in advance. Yearly billing is ten times the monthly price. Taxes are shown at checkout where they apply. There is no free trial; a card is required at signup. Payment is handled by our payment provider; we do not store card details. We may change prices with at least 30 days’ notice; the change applies from your next renewal.

6. The 60-day refund promise

You may ask for a full refund of any device line within 60 days of its first charge, from your account page or by email, no questions asked. The refund goes back to the original payment method. Backups for that device stop, and its backup stays readable for the 90-day grace period, after which it is deleted. Renewals after the first 60 days are not refundable except where the law says otherwise.

7. Cancelling, grace and payment failures

You can cancel any device line at any time from your account page or by removing the device in the app. Backups stop immediately. The backup stays readable for 90 days (the grace period) so you can still restore, after which it is deleted. If a renewal payment fails, backups pause and the same 90-day grace period applies; updating your payment method within it resumes the line with its history intact.

8. Acceptable use

Don’t use Yester to store material that is illegal for you to hold, to attack the service, or to circumvent limits. We can suspend an account that does. We never look at the content of backups — we can’t — so enforcement is based on account behaviour, not on your files.

9. Availability and changes

We aim to keep Yester running all the time but we don’t promise it will be, and backups that are delayed catch up by themselves. The status page shows current availability. We may change or discontinue features; if we discontinue the service we will give at least 90 days’ notice and keep restores available for that period.

10. Liability

To the extent the law allows, our liability to you for any claim arising from the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for data that could not be restored because a recovery key was lost, because a device was excluded or offline, or because of causes outside our control. Nothing in these terms limits liability that cannot be limited by law, including your statutory rights as a consumer.

11. Ending the agreement

You can close your account at any time; all device lines are cancelled and the grace period in section 7 applies. We may end the agreement with 30 days’ notice, or immediately for a serious breach of section 8.
